Videography & Photography Terms

1. Scope
These terms apply to filming, editing, and photography services booked through our Get Started form, as distinct from the shop's digital products and workshops. The specific price, timeline, deliverables, and usage rights for your project are confirmed with you in writing before any booking is final, and can adjust any of the defaults below by mutual written agreement.
2. Copyright & usage rights
Every photo and video we capture remains our intellectual property. You're granted a personal, non-exclusive license to use the delivered final images and videos for the purposes agreed in writing. We retain the right to use any images or footage for our portfolio, website, social media, competitions, exhibitions, and other promotional purposes.
If you want exclusive rights that prevent us from any future use, that requires a separate written agreement and an additional fee. We also reserve the right to compile and sell clip packs or stock footage of subjects filmed during a shoot (for example, cars, objects, or scenes) without further compensation to you; if you don't want your footage included in such packs, an additional exclusivity fee applies.
3. Credit & attribution
You agree to credit us clearly on any publicly shared images or videos, including social media posts, websites, and printed materials. On Instagram, we must be added as a collaborator on any reel or post and not removed, unless otherwise agreed in writing. If you'd rather not credit us, an additional fee applies; that fee doesn't grant exclusivity, which is negotiated separately.
4. Delivery & revisions
Unless otherwise agreed, final deliverables arrive in the agreed format and resolution within 4 weeks of the shoot date, and are considered accepted unless you raise issues within 4 days of delivery. One round of minor revisions is included free of charge, adjustments like color, brightness, simple cuts, or slight timing shifts. Major changes, like replacing music or restructuring the edit, aren't minor and incur an additional fee.
5. Payment & fees
A booking deposit of 50% of the total is required to secure your date. Of that deposit, 25% of the total is a non-refundable retainer; the remaining 25% is refundable if you cancel. The balance is due in full before delivery, and late payments carry a 5% per week overdue fee.
6. Cancellations, rescheduling & cooperation
If you cancel a booking, 25% of the total (the non-refundable portion of the deposit) is retained; the other 25% is refunded. Rescheduling is possible subject to availability and may incur additional costs. You agree to cooperate fully, arrive on time, and provide any necessary materials or permissions; delays or lack of cooperation can affect the final product, and we're not responsible for that impact.
7. Deliverables & file storage
We deliver only the final, edited images and videos; raw or unedited footage isn't included unless agreed in writing for an additional fee. Final deliverables are stored for 90 days after delivery; after that window, retrieval may not be possible or may incur a fee.
8. Client-provided assets
You're solely responsible for having the rights or licenses to any materials you provide us, logos, music, text, or otherwise. We're not liable for copyright infringement caused by assets you supply.
9. Turnaround time & force majeure
We make every reasonable effort to meet deadlines, but unforeseen circumstances, illness, extreme weather, or technical failures, may delay delivery. If that happens, we'll notify you and offer to reschedule or refund as appropriate.
10. Limitation of liability
Our liability is limited to the total amount you paid for the assignment. We take reasonable care to back up files, but aren't liable for unavoidable technical failures.
11. Referral program
If you've previously booked a shoot with us for at least $250, you're eligible to earn a reward for referring someone who books their own shoot. Once their project is paid in full, you'll receive either a free dedicated session (15 to 20 edited images or a 15 to 20 second cinematic video) if it can be scheduled within our normal service area, or, if travel makes a new session impractical, one free additional edit from footage captured during your own previous shoot.
When you tell us who referred you, you must provide the exact name and email address that person used when they originally contacted us; mismatched details may delay or void the reward. Each referred client counts once, and must be identified as a referral before their booking is confirmed. To confirm a referral, we may contact the client who referred them directly for verification before honoring any reward. Rewards are personal, non-transferable, have no cash value, and must be claimed within 12 months of the referred booking's completion. We may update or discontinue this program at any time; changes apply only to future referrals.
12. Governing law & venue
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, regardless of where a shoot physically takes place. Any dispute is subject to the exclusive jurisdiction of the courts located in New Castle County, Delaware, unless mandatory consumer protection law requires otherwise.
Global consumer-law safeguard. If you're a consumer in a country with mandatory protections (for example the EU, EEA, or UK), nothing here deprives you of the protections granted by the law of your habitual residence. Any choice of law or venue above applies only to the extent it doesn't override those mandatory rights.
Local regulations at the shoot location. Because a shoot involves being physically present somewhere, local rules that can't be waived by agreement, filming permits, drone regulations, safety, labor, environmental, tax, and data privacy law, still apply in the country or state where the shoot takes place, regardless of the governing law above.
13. Agreement
